    Colchester 9 miles.
    Sudbury 9 miles.
    Hadleigh 8 miles.

    Situation
    The land at Leavenheath is located to the west of the A134 Colchester to Sudbury Main Road with access being provided off Radleys Lane. The land is on the edge of the village of Leavenheath some 9 miles to the east of Colchester.

    Description
    A compact block of arable land farmed in two main blocks with good sized fields and a central track. The land extends to approximately 133 acres as shown on the plan.

    Access is provided off a minor public highway Radleys Lane via the A134 with a main track going through the middle of the land.

    The soils are classified by DEFRA as Grade 2 and is of the Ashley soil series being fine loam over clay. There is a mains water supply to this land but no electricity supply.

    The Basic Payment Scheme entitlements are held by the Vendor and will transfer with the sale.

    The land is crossed by public footpaths going east west and north south across the holding.

    An overage arrangement will apply on the land whereby the Vendor will be entitled to 20% of any additional value above agricultural value over the next 25 years.

    Tenure
    The land is offered for sale freehold with vacant possession upon completion.

    The land is subject to a contracting arrangement with a local farmer until after this harvest.

    Designations
    The land is within a Nitrate Vulnerable Zone.

    Town and Country Planning
    The property is offered subject to any current or past development, designation and policies, tree preservations orders, town planning schedules, applications, submissions and resolutions, that may be or may come into force. The purchaser will be deemed to have full knowledge and have satisfied themselves as to the provisions of any such matters affecting the property.

    Basic Payment Scheme
    The entitlements are transferring with the land and included within the purchase price.

    Plans, Areas and Schedules
    The boundaries are based on the Ordinance Survey and are for
    reference only. The purchaser will be deemed to have full knowledge of the boundaries and any error mistake should not annul the sale or entitle any party to compensation in respect thereof.

    Should any dispute arise as to boundaries or any points on the
    General Remarks and Stipulations, particulars, schedules, plans or the interpretation of any of them, such questions shall be referred to the selling agent whose decision acting as expert should be final.

    Wayleaves, Easements, Covenants and Rights of Way
    The property is sold subject to, with the benefit of, all existing
    wayleaves, easements, quasi-easements, rights of way, covenants and restrictions, whether mentioned on these particulars or not. There are footpaths crossing the land as shown on the attached plan. There will be an overage covenant on the land retaining to the Vendor 20% of any uplift in value over agricultural value for a 25 year period.

    VAT
    The sale of the property is not a chargeable supply for the purposes of VAT and no such tax will be payment by the purchaser in addition to the sale price.

    Exchange and Completion
    Exchange of contracts to take place with a 10% deposit within 28 working days from receipt of the draft contract from the Vendor's Solicitor, completion to take place post harvest.

    Directions
    Heading north from Colchester take the A134 through Great Horkesley and bypass Nayland before coming up the hill into Honey Tye. Radleys Lane lies to the left hand side almost opposite the public house. Having headed down Radleys Lane the land lies to the right hand side.

    From Sudbury take the A134 towards Colchester and having passed through the village of Leavenheath, the land lies to the right hand side opposite Honey Lane and can be accessed via Radleys Lane which can be found on the right hand side opposite the public house.
